WHAT IS THE LAW Nº 14.300/2022?

Law No. 14,300/2022 establishes the legal framework for microgeneration and minigeneration of energy. Under this law, all consumers in the country can produce their own energy through renewable sources.

 

HOW LONG IS IT POSSIBLE TO INSTALL THE SOLAR ENERGY SYSTEM BEFORE THE NEW LAW IS PASSED?

Anyone who requests access to solar power generation systems by January 6, 2023, will be guaranteed the maintenance of current rules until 2045, meaning no taxation.

 

WHAT WILL HAPPEN AFTER 2045 FOR THOSE WHO INSTALL THE SYSTEM BY JANUARY 6, 2023?

After this date, there will be a gradual and staggered charge on energy injected into the grid. The charge is called TUSD Fio B or Tariff for Use of the Distribution System, which charges consumers for using the utility's infrastructure (cables, poles, etc.) to "inject" their excess energy generation.

 

EVEN WITH THE CHANGES, IS SOLAR ENERGY STILL A GOOD OPTION?

Yes, solar energy will still remain an economical alternative, in addition to being better for the environment.

 

IS IT POSSIBLE TO REQUEST ACCESS TO THE SYSTEM AFTER JANUARY 6, 2023?

Yes, you can apply at any time, however, requests made until January 6, 2023, 12 months after the law's publication, will be exempt from paying the fee until 2045. Those who request access between the 13th and 18th month after the law's publication will have an eight-year exemption before having to pay the fee, and after the 18th month, the period drops to six years.

 

CAN ALL MUNICIPALITIES IN THE COUNTRY HAVE ACCESS TO SOLAR ENERGY?

Data from Absolar shows that photovoltaic solar technology is already present in 5,502 municipalities and in all Brazilian states, with the leading states in installed capacity being, respectively: Minas Gerais, São Paulo, Rio Grande do Sul, Mato Grosso and Santa Catarina.
"There's enormous potential to be unlocked when it comes to solar energy. Even considering the "sun tax," as the Distributed Generation Legal Framework, sanctioned by the Federal Government in early January 2022, is being called, solar energy remains a much more economical alternative, in addition to being better for the environment," explains Elétron Energy CEO André Cavalcanti. "We intend to invest more than R$1,400 million in renewable energy projects by 2024, in addition to consolidating other projects involving photovoltaic, wind, and hydroelectric sources," he emphasizes.
